RETURNS & REFUNDS POLICY

This Returns & Refunds Policy applies to purchases of products sold by Beast Mode (“Beast Mode”, “we”, “us” or “our”).

By purchasing from Beast Mode, you acknowledge that you have read this policy.

This policy is intended to operate in accordance with the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 (“CPA”) and, where applicable, the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”).

Nothing in this policy is intended to remove, restrict or waive any consumer right that cannot lawfully be excluded. If any provision of this policy conflicts with a mandatory provision of South African law, the applicable law will prevail.

1. CHANGE-OF-MIND RETURNS

Beast Mode may accept returns where a customer has simply changed their mind, subject to the conditions below.

Unless a different statutory right applies, a change-of-mind return must be requested within 14 days of delivery.

The product must:

* be unused;
* not have been exercised with;
* not have been stretched or subjected to resistance;
* not show signs of wear;
* not have been cut, punctured, torn or modified;
* be in its original condition;
* include all original accessories and components; and
* where reasonably possible, be returned in its original packaging.

Because resistance bands are exercise equipment, a band that has been used for exercise will generally not qualify for a voluntary change-of-mind return.

For voluntary change-of-mind returns, the customer is responsible for reasonable return shipping costs, except where applicable law requires Beast Mode to bear those costs.

This section does not affect any statutory right to return defective, unsafe, incorrectly supplied or otherwise non-compliant goods.

2. DEFECTIVE OR UNSAFE PRODUCTS

Beast Mode stands behind the quality of its products and complies with applicable statutory consumer protections.

Under the CPA, qualifying goods carry an implied warranty of quality. Within six months after delivery, a consumer may return qualifying defective or unsafe goods without penalty and at the supplier’s risk and expense. Where the statutory requirements are met, the consumer may be entitled to choose a repair, replacement or refund. (DTIC)

Accordingly, if you believe that a Beast Mode product has a manufacturing defect or is unsafe, contact us as soon as reasonably possible.

Examples of potential product defects may include:

* premature failure attributable to a manufacturing defect;
* a material defect;
* a fault present in the product that existed independently of normal use; or
* another failure that means the product does not satisfy applicable statutory quality requirements.

Beast Mode will assess the claim in accordance with applicable law.

3. DAMAGE CAUSED BY USE OR MISUSE

Resistance bands are exercise products and are designed to be used in accordance with their intended purpose and supplied instructions.

Subject to any rights provided by law, Beast Mode is not responsible for damage caused by misuse, abuse, improper handling or use outside the intended purpose of the product.

Examples may include:

* deliberately cutting or puncturing the band;
* attaching the band to unsuitable, sharp or abrasive objects;
* using the band against sharp edges;
* exposing the band to damaging chemicals or substances;
* exposing the band to excessive heat;
* intentionally overstretching the band beyond its intended use;
* modifying or altering the band;
* attempting unauthorised repairs;
* storing the band in unsuitable conditions;
* using the product for a purpose for which it was not designed;
* accidental damage;
* deliberate damage; or
* damage caused by negligence or improper handling.

Where a customer submits a defect claim, Beast Mode may reasonably request photographs, videos, proof of purchase and other information necessary to assess the claim.

This section does not exclude a consumer’s statutory rights where a defect existed independently of the customer’s misuse.

4. NORMAL WEAR AND TEAR

Resistance bands are consumable exercise equipment and may naturally experience wear as they are used.

Normal wear and tear does not, by itself, establish that a product was defective.

Examples may include gradual deterioration resulting from ordinary use, provided that such deterioration is consistent with the product’s expected use and does not result from a manufacturing defect or other circumstance for which Beast Mode is legally responsible.

Beast Mode will assess alleged premature failure fairly and in accordance with applicable law.

5. WRONG PRODUCT OR INCORRECT ORDER

If Beast Mode sends you:

* the wrong product;
* the wrong resistance level;
* an incorrect quantity; or
* a materially different product from the one ordered,

please contact us as soon as reasonably possible.

We will investigate the issue and, where Beast Mode is responsible for the error, provide the remedy required by applicable law.

Where reasonably possible, please provide photographs of the product and packaging together with your order number.

6. PRODUCTS DAMAGED BEFORE OR DURING DELIVERY

If your order arrives visibly damaged, please photograph the packaging and product before disposing of any packaging materials.

Contact Beast Mode as soon as reasonably possible.

Where the damage occurred before delivery or otherwise falls within Beast Mode’s legal responsibility, Beast Mode will provide the appropriate remedy required by applicable law.

Customers should not attempt to repair a product before contacting Beast Mode regarding a suspected defect.

7. HOW TO MAKE A RETURN OR DEFECT CLAIM

Please provide:

1. Your full name;
2. Order number;
3. Date of purchase;
4. Product purchased;
5. Reason for the return;
6. Description of the issue; and
7. Photographs or video where reasonably relevant.

Beast Mode may request reasonable additional information to determine the nature of the claim.

8. RETURN AUTHORISATION

Customers should contact Beast Mode before sending products back.

We will provide return instructions where a return is appropriate.

Sending an item back without following the return instructions may cause unnecessary processing delays.

This administrative requirement does not remove or restrict any statutory consumer right.

9. PRODUCT INSPECTION

Where reasonably necessary, Beast Mode may inspect a returned product to determine:

* whether it is the product purchased from Beast Mode;
* whether it has been used;
* whether it has suffered ordinary wear and tear;
* whether there are signs of misuse or modification;
* whether the alleged defect is present;
* whether the product was damaged after delivery; and
* whether the issue appears to be a manufacturing or other qualifying defect.

An inspection will not replace or override any remedy that the consumer is legally entitled to under the CPA or other applicable legislation.

10. REFUNDS

Where a refund is legally required or otherwise approved by Beast Mode, the refund will generally be processed using the original payment method where reasonably possible.

The time it takes for funds to appear in the customer’s account may depend on the relevant bank, payment processor or payment method.

Where applicable law specifies a refund period, Beast Mode will comply with that requirement.

11. SALE AND DISCOUNTED PRODUCTS

Products purchased during promotions, sales or at discounted prices remain subject to applicable statutory consumer rights.

A discounted price does not remove statutory rights relating to defective, unsafe or non-compliant goods.

Where a specific defect or limitation was properly disclosed to the consumer before purchase, and the consumer knowingly accepted the product in that condition, the applicable legal position may differ.

12. “NO REFUND” DOES NOT OVERRIDE THE LAW

Beast Mode does not operate a blanket policy that unlawfully prevents refunds.

Where South African law requires Beast Mode to provide a refund, replacement or repair, Beast Mode will comply.

A voluntary change-of-mind return is separate from a statutory claim relating to defective, unsafe or non-compliant goods.

13. ONLINE PURCHASES AND COOLING-OFF RIGHTS

Where a purchase is subject to a statutory cooling-off right under applicable South African legislation, Beast Mode will honour that right.

Nothing in this policy is intended to exclude or restrict an applicable statutory cooling-off period.

Any applicable cooling-off return will be handled in accordance with the relevant legislation and its requirements.

14. PROOF OF PURCHASE

Beast Mode may reasonably request proof that the product was purchased from Beast Mode.

Acceptable proof may include:

* order confirmation;
* invoice;
* receipt;
* order number; or
* other reasonable transaction records.

This requirement will not be applied in a manner that unlawfully restricts statutory consumer rights.

15. THIRD-PARTY PURCHASES

If you purchased a Beast Mode product through an authorised third-party retailer or marketplace, please contact the seller from whom you purchased the product regarding the transaction.

The seller may have its own administrative return procedure.

Nothing in this section limits rights that cannot legally be excluded.

16. PRODUCT SAFETY

Beast Mode resistance bands are intended for exercise and fitness use.

Customers must use the products responsibly and follow all instructions and warnings supplied with the product.

Before each use, customers should reasonably inspect the band for visible damage, deterioration or other conditions that could make continued use unsafe.

If a band appears damaged or unsafe, do not continue using it and contact Beast Mode.

Beast Mode may, where reasonably necessary and subject to applicable law, issue safety notices, product recalls or corrective measures.

17. LIMITATION OF LIABILITY

To the maximum extent permitted by South African law, Beast Mode will not be liable for loss or damage arising from:

* misuse of a product;
* use contrary to supplied instructions or warnings;
* unauthorised modification;
* unauthorised repair;
* use for a purpose for which the product was not supplied;
* improper storage;
* improper handling;
* accidental damage;
* deliberate damage; or
* ordinary wear and tear.

Nothing in this section excludes or limits any liability or consumer right that cannot legally be excluded or limited.

18. FRAUDULENT OR ABUSIVE RETURN CLAIMS

Beast Mode reserves the right to investigate suspected fraudulent, dishonest or abusive return claims.

Examples may include knowingly providing false information, attempting to return a product that was not purchased from Beast Mode, intentionally damaging a product and presenting the damage as a manufacturing defect, or repeatedly abusing voluntary return procedures.

Any action taken by Beast Mode under this section will be subject to applicable law and will not interfere with legitimate statutory consumer rights.

19. POLICY CHANGES

Beast Mode may update this policy from time to time.

The version applicable to a particular transaction will generally be the version applicable at the time of purchase, subject to any subsequent mandatory legal requirements.

20. GOVERNING LAW

This policy is governed by the laws of the Republic of South Africa.

Any consumer rights that apply under mandatory South African legislation remain unaffected by this policy.
